Plaintiff recovered a $75,000 judgment against defendant entered on a jury’s verdict in the Circuit Court of St. Clair county for personal injuries sustained in a crossing accident in Kansas City, Missouri. Defendant’s motion to dismiss based on the doctrine of forum non conveniens was not sustained by the trial court. This ruling, together with assignments of error in excluding evidence, in instructing the jury, as to the manifest weight of the evidence, and as to excessiveness of verdict forms the basis of defendant’s appeal.
