Plaintiffs bring suit against the Federal Deposit Insurance Corporation (“FDIC”) in its capacity as the receiver for Crossland Savings Bank, FSB (“Crossland”), which was closed by the United States Office of Thrift Supervision (“OTS”) on January 24, 1992. Plaintiffs seek to hold the FDIC liable, pursuant to the Financial Institution Reform, Recovery, and Enforcement Act of 1989 (“FIRREA”), Pub.L.
