(after stating the facts as above). The patents in suit relate to alleged improvements either in the apparatus or in the processes for producing a so-called “permanent” wave in the hair while on the human head. Prior to the patents in suit hair had *782been waved, both when on the human head and after it had been removed from the head and made up into “switches” and sold as “commercial” hair. A large business has been developed under the patents in suit.
