WEXLER, District Judge.
Bocre Leasing Corporation (“plaintiff’ or “Bocre”) brought a used helicopter from Edwards and Associates (“Edwards”), a broker of used aircraft. The helicopter, which was manufactured by Allison Gas Turbine Division of General Motors Corporation (“defendant” or “Allison”), failed while in flight. Although no one was injured as a result of the failure, the helicopter itself sustained damage.
