This is an appeal from an order entered pursuant to CPLR 3124 compelling discovery and inspection pursuant to a notice served under CPLR 3120.

*318The action is one for damages resulting from personal injuries sustained at defendant’s premises. Defendant’s attorney was served on April 22, 1964 with a notice seeking discovery and inspection on April 30, 1964 of six items.
