OPINION
DROWOTA, Judge.
This is an appeal from an order of the Rutherford County Circuit Court which granted the defendant’s motion for judgment on the pleadings and dismissed the plaintiffs’ complaint. Plaintiffs originally perfected an appeal to the Tennessee Su preme Court, however after an examination of the record by that Court and a determination by that Court that jurisdiction was in the Court of Appeals, this cause was transferred to this Court for disposition.
