RULING ON PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT

This matter is before the Court on a motion for summary judgment filed by the plaintiff, Resure, Inc. (“Resure”). For the reasons which follow, the motion is granted.
FACTS AND PROCEDURAL HISTORY
On July 16, 1993, a parked tanker truck exploded in Port Allen, Louisiana, destroying several nearby vehicles and releasing a plume of contaminants into the surrounding atmosphere.
