The Department of Transportation, Bureau of Driver Licensing (DOT) appeals from the Order of the Court of Common Pleas of Delaware County, entered June 22, 1989, which sustained Thomas V. Osborne’s (Osborne) appeal of his license suspension.

On the evening of July 9, 1988, Osborne was involved in an accident. The police officer who arrived at the scene to investigate noticed that Osborne’s eyes were bloodshot and that his speech was slurred, and the officer smelled alcohol *299on his breath.
