MEMORANDUM OPINION

COLLEEN KOLLAR-KOTELLY, District Judge.

Defendant Paul David Hite is charged by superseding indictment with two counts of attempted coercion and enticement of a minor in violation of 18 U.S.C. § 2422(b). Superseding Indictment, ECF No. [10], at 1-2. The Defendant previously moved to dismiss both counts of the superseding indictment on the grounds that the statute prohibits attempted enticement by way of direct communications with a minor only, but does not prohibit attempted enticement through an adult intermediary.
