¶1 Lake Washington Rowing Club obtained permits from the Department of Natural Resources (DNR), the city of Seattle, and the Army Corps of Engineers (ACE) to install a ramp and floating dock in Waterway 23 at the north end of Lake Union. Northlake Marine Works, Inc., operates a marina on property adjacent to Waterway 23. Northlake filed a state court challenge to DNR’s and the city’s statutory authority under state law to issue the permits. DNR argued that Northlake failed to *277exhaust its administrative remedies and also that DNR had statutory authority to issue the permits.
