I. Background

This is an appeal from a decision by the United States Bankruptcy Court (Krechevsky, J.) in an interpleader action brought by Pepsi-Cola Newburgh Bottling Co., Inc. (“Pepsi”). At issue is the garnishment sought by appellant Bristol Savings Bank (“Bristol Savings”) of two payments owed by Pepsi pursuant to a non-competition agree*102ment with debtor Aaron P. Silver (“Silver”). Bristol Savings, Silver’s creditor, claims ownership of the payments as a result of garnishments it served in April 1992.…
