GARDNER, Chief Justice.

This appeal is from a conviction of murder in the second degree with punishment fixed at imprisonment for a period of twenty-five years.

Defendant is charged with the murder of his daughter, Addie Ruth Booth, a young girl near fourteen years of age, who was well developed and rather large for her age. She lived with her father in a house at Kimberly, Alabama, and not far from Warrior.
