On exceptions. This case, which had been appealed from the Municipal Court for the City of Portland, was heard in the Superior Court for Cumberland County by the presiding justice who rendered judgment for the defendant. The plaintiff’s exceptions to this ruling were allowed.

The declaration contains three counts. The first is assumpsit upon an account annexed. The second is a special count alleging both express and implied warranties by the defendant respecting the condition of a refrigerator sold by him to the plaintiff for the sum of one hundred dollars, which the plaintiff paid, a breach…
