On January 30, 2002, Appellant was convicted for the felony offense of possession of a controlled substance with intent to deliver methamphetamine of 4 grams or more but less than 200 grams. Tex. Health & Safety Code § 481.112 (Vernon 2002). Appellant appealed, claiming that the trial court erroneously denied his request for a lesser-included offense-instruction.
