Mildred Barnhart, appellee, recovered a judgment against Paul A. Coin, appellant, in the circuit court of Hamilton county for the sum of $1,500 for personal injuries suffered by her in an automobile accident.
The declaration contained seven counts, but the third and fourth counts were stricken at the close of plaintiff’s testimony. The first and second counts charged general negligence in the operation and management of the automobile and the driving of the same at a high rate of speed.
