On the petition of relator filed in this court at the October term thereof, 1916, a writ of habeas corpus was issued to the respondent, as superintendent of the house of correction in the city of Chicago, commanding him, among other things, to show cause of imprisonment of the relator. From the petition and the answer of the respondent it appears that the petitioner was arrested on the second day of October, 1916, in the city of Chicago, upon a warrant based upon an information wherein he was charged with living in an open, state of adultery with Anna Walsh.
