OPINION

WOZNIAK, Judge.

The Commissioner of Public Safety appeals from an order rescinding the revocation of respondent Kevin Keane’s driving privileges under the implied consent statute. We reverse.

FACTS

Shortly after midnight on April 19, 1984, Lovell Jackson, a Neighborhood Assistance Officer with the St. Paul Police Department (not a certified peace officer), was patrolling Como Avenue when he observed respondent Keane driving very erratically.
