*707In an action to recover damages for personal injuries, the defendants appeal from an order of the Supreme Court, Nassau County (Jaeger, J), dated January 13, 2006, which denied their motion pursuant to CPLR 3211 (a) (5) to dismiss the complaint on the grounds of res judicata and collateral estoppel.

Ordered that the order is affirmed, with costs.
