The defendant was found guilty by a jury in the Superior Court (Morrill, J.) of the offenses of simple assault, RSA 631:2-a, and resisting arrest, RSA 642:2. The defendant raises three issues on appeal. First, he claims error in the trial court’s failure to instruct the jury that it must consider the conduct and knowledge of the officer’s superior, the chief of police.
