Appeal from a judgment of the Erie County Court (Michael F. Pietruszka, J.), rendered November 30, 2011. The judgment convicted defendant, upon a nonjury verdict, of criminal sexual *1221act in the first degree and attempted aggravated sexual abuse in the third degree (two counts).

It is hereby ordered that the judgment so appealed from is unanimously affirmed.
