BROWN, Justice.

This is a common law action of assumpsit by Josephine Harrison, who, as the complaint alleges, is also administratrix of the estate of her deceased husband, who was killed while actually engaged in the construction of one of the state’s public roads, against the petitioner, Employers Insurance Company of Alabama, for breach of the condition of an insurance policy procured by the State Highway Department authorized by § 3, Title 23, Code of 1940. Said section of the code which enumerates the powers and duties of said department provides inter alia :
