LAWSON, Justice.

O. B. Dunlap, an employee of the highway department of the State of Alabama, was killed by lightning on July 20, 1960, as he was guarding convicts who were working on a highway in Cullman County.

Mary Eula Dunlap, as administratrix of the estate of her deceased husband, instituted this suit in the Circuit Court of Cull-man County against United States Fidelity & Guaranty Company, a corporation, for breach of the conditions of an insurance policy procured by the state highway department as authorized by § 3, Title 23, Code 1940, as amended.
