Third-party defendant’s motion to dismiss the third-party complaint pursuant to CPLR 3211 (a) (7) is granted.

The action was commenced against a used car dealer, Mona*689han Ford Corp. of Flushing (Monahan), to recover under General Business Law § 198-b, more commonly known as the "Used Car Lemon Law”.
