for the Court.

The defendant, Jose L. Barrientos, appeals from a Superior Court judgment of conviction declaring him to be in violation of the terms of his probation and sentencing him to five years of his previously suspended sentence. On appeal, the defendant argues that the hearing justice acted arbitrarily and capriciously in finding that the defendant violated the terms of his probation.
