OPINION
LEDERBERG, Justice.
This case came before the Supreme Court on the appeal of the defendant, Timothy Kennedy, from a Superior Court adjudication that he violated the terms of a previously imposed twenty-one-and-a-half-year suspended sentence and probationary period. The defendant argued that the hearing justice overlooked and misconceived the material evidence and that the resulting adjudication was arbitrary and capricious.
