The principal question to be considered is that of the right of the plaintiff to recover damages as and for a breach of the contract. It is claimed that the contract was breached in the first place when the defendant failed to plant sufficient seed to produce the amount of peas which he had contracted to deliver to the Wisconsin' canneries. It does not seem necessary for us to determine with precision the exact effect of defendant’s failure to plant sufficient seed to produce the amount of peas which he had contracted to deliver to Wisconsin canneries.
