The plaintiff was injured in endeavoring to get upon one of the' cars of the defendant’s railroad at Astor place and Broadway. He. was a passenger upon a Broadway car coming uptown and alighted from this car at Broadway and Astor place, receiving a transfer-ticket which would entitle him to continue his route uptown upon the Madison avennue line starting from the intersection of Astor place and Broadway.
