Appeal from order of the General Term of the Supreme Court, in the first judicial department, made December 11, 1883, which affirmed a judgment in favor of plaintiff, entered upon a verdict, and granted a new trial. 1Opinion of the CourtEarl, J.

This action was commenced to recover damages sustained by the plaintiff from personal injuries received by him in consequence of a defect in a street in the city of Hew York. He recovered a verdict of $25,000, but his judgment was reversed at the General Term, and then he appealed to this court.

The reversal of the General Term, as appears by its opinion, was upon the sole ground that the duty of repairing the street, at the place of the accident, was by law devolved upon the park department and not upon the city.
