— This matter is before the court pursuant to the motion for judgment on the pleadings of defendants Leon J. Ghougasian and Susan L. Ghougasian, pursuant to the Pennsylvania Rules of Civil Procedure, Rule 1034. The motion of defendants is denied.

Plaintiff, Elmwood Terrace Limited, is the owner of a certain tract of land by deed dated May 31, 1990, and recorded on June 1, 1990, known as 1414 East Market Street.
