Plaintiff in error was plaintiff, and' the defendant in error defendant, in the court below, and will be referred to herein as plaintiff and defendant.

This is an action at law, arising out of a contract entered into between the plaintiff and the defendant, on the 4th of August, 1919. whereby the defendant contracted with plaintiff to purchase certain cotton seed oil machinery, upon the terms and conditions set forth in the contract.
