Tbe plaintiff in error, who was defendant in tbe Circuit Court, is a corporation organized' under tbe laws of Wisconsin. It bad undertaken to biuld tbe whole or a large part of tbe Wisconsin Central Railroad, and had made contracts with tbe defendants in error, whom we shall hereafter call plaintiffs, as they were in tbe Circuit Court, for the construction of a part of this road. These contracts were drawn with tbe minuteness of detail usual in such cases, and provided, among other things, that payments should be made by defendant, as tbe work progressed, on estimates made monthly…
