This matter comes before the Court on motions by Megan Racine Associates, Inc. (“Debtor”) and Federal Deposit Insurance Corporation (“FDIC”), as receiver for the New Bank of New England, in the adversary proceeding commenced by Niagara Mohawk Power Corporation (“NIMO”) against Debtor and FDIC.
