Ferguson, Judge:

The codal violations of which Greene was convicted are not related to the issues before this Court. Rather, we are concerned with the composition of the court-martial selected to try the accused and with whether the accused was denied his right to an impartial post-trial review. Because of the action we take in this case we need not reach the second issue. At the outset of trial, during the Article 39(a) session, defense counsel stated that although the accused was requesting that he be tried by the military judge alone, he was doing so reluctantly and only…
