The complaint alleges that the plaintiff is the owner (subject to the paramount title of the United States) and in possession and entitled to the possession of the Copper Globe and the Copper Globe No. 1, No, 2, No. 3 and No. 4 mining claims, situate in Emery county, Utah.; that the defendants, who are the appellants, claim an interest in said mining claims adverse to the plaintiff, but that such claim is without right.
