Appellant CMA-CGM (America) Inc. appeals the trial court’s final summary judgment order. We affirm.

BACKGROUND

In October of 2003, while Hector Aguirre (a Texas resident) was working as an independent truck driver for appellee Empire Truck Lines, Inc. (a Texas corporation), he was directed by Empire to transport cargo from Longview, Texas to the Port of Houston.
