VAN GRAAFEILAND, Circuit Judge:
Appellant was subpoenaed by plaintiff to appear for deposition as a witness in a libel action against the author and publishers of a book entitled Wanted: The Search for Nazis in America. Appellant’s pro se motion to quash the subpoena was referred by the district court to Magistrate Harold J. Raby, who denied the motion. Appellant then testified and answered all but two questions.
