This action was brought to recover a balance claimed to be due to the plaintiff for services as a police officer. The complaint alleged and the referee has found that the plaintiff was employed by the defendant as one of its police officers on June 1, 1890, and that he performed the duties of such office until April 1, 1894, and that the employment was under and by virtue of chapter 445 of the Laws of 1887 and the acts amendatory thereof. The plaintiff testified- that he was discharged on October 27, 1893, and there is no testimony in the case that he was employed after that date.
