The defendants in this action are a corporation formed under the general act of May 7, 1847, authorizing the incorporation of companies for the construction of plank roads. The road which they purposed to build was to extend from the Hudson river at Fishkill Landing through the towns of Fishkill and East Fishkill, to a point in the town of Beekrnan, specified in their articles. In July, 1851, they entered into an agreement with the supervisor and commissioners of highways of the town of Fishkill for the use of a certain highway in the town, according to the provisions of section 26…
