(dissenting). I do not agree that the summons and complaint in this action and the service thereof upon the defendant by personal service in the state of Nevada were sufficient to vest the district court with jurisdiction to decree the part of the judgment from which the defendant has appealed. The summons warns the defendant that upon his failure to answer, judgment will be rendered against him as prayed for in plaintiff’s complaint. The defendant’s property is mentioned in the complaint.
