The plaintiffs seek rescission of the appointment of the defendant Patrick Schiavone to the position of police chief of the city of Lawrence. At the time of his appointment by vote of the Lawrence city council, Patrick Schiavone and the plaintiffs were captains in the Lawrence police department and the only persons on the civil service list eligible for appointment to chief.
