RIPPLE, Circuit Judge.
Petitioner Danny Davis appeals from a judgment of the district court denying his petition for a writ of habeas corpus. Mr. Davis contends that his due process rights were violated when he was convicted by the state of Indiana of nonsupport of a dependent child, a violation of Ind.Code § 35-46-1-5 (1986). Mr. Davis claims that the state impermissibly shifted to him the burden of proving by a preponderance of the evidence his inability to pay support for his three children. 657 F.Supp. 469.
