In a civil proceeding under Code § 37.2-900 et seq., Dax A. Ellison was found to be a sexually violent predator and was involuntarily committed to the custody of the Department of Mental Health, Mental Retardation and Substance Abuse Services (the Department) for secure inpatient treatment. At his civil trial and over his objection, the court permitted the Commonwealth to introduce evidence from an earlier criminal trial in which Ellison had been tried for rape and acquitted by a jury.
