MEMORANDUM AND ORDER

ROGERS, District Judge.

This is an appeal from an adversary proceeding in a Chapter 7 bankruptcy. This case is now before the court upon the motion to dismiss of the Farm Credit Bank of Wichita. The bankruptcy trustee, Eric Ra-jala, joins in the motion. The court has conducted oral argument on the motion. For the reasons discussed below, the court believes the motion should be granted.
