NEWMAN, District Judge.

This case having been tried by the court with a jury, and a verdict having been rendered in favor of the plaintiffs, the defendant made a motion for new trial, and the present hearing is on that motion.

The suit was brought by Haven & Clement against D. W. James for $10,145, “for work and labor done, services rendered, and money paid out and expended by said plaintiffs during the months of October, November, and December, 1904, at the instance and request of the defendant,” which amount it is alleged the defendant afterwards, in consideration of the premises, promised to…
