Appeal from the circuit court of Harrison county. Hon. T. H. Barrett, Judge. Suit by T. N. Jordan, against the Illinois Central Bail-road Company. From a judgment for plaintiff, defendant appeals. The facts are fully stated in the opinion of the court. The next error of which we complain was the action of the trial court in sustaining the plaintiff’s objection to paragraph 5 of the bill of lading, and in excluding the paragraph from consideration in this case.

This case was before the court on a former appeal. Jordon v. Railroad Co., 102 Miss. 21, 58 So. 595.
Appellant assigns as error the action of the trial court in overruling the defendant’s motion to exclude the testimony offered by the plaintiff and to direct a verdict in its favor. We cannot say that the evidence in this case on behalf of appellee is not sufficient to uphold a verdict in his favor.
The next assignment by counsel for appellant is that the trial court erred in excluding from the jury the testimony of the witness A. H. McSwain that appellee had *145not paid him in full for the oxen.…
