Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Tioga County) to review a determination of respondent Tioga County Mental Hygiene Department which terminated petitioner’s employment.

Petitioner Susan Vaziri-Cohen (hereinafter petitioner), was employed as a mental health nurse by respondent Tioga County Mental Hygiene Department (hereinafter respondent) for approximately five years.
