THIS MATTER is before the Court pursuant to the Consent Order Authorizing the Sale of Real Property and Escrow-ing One-Half of the Proceeds From the Sale of Real Property (“Consent Order”) between Robert F. Anderson (“Trustee”) and EMC Mortgage Corporation (“EMC”). The remaining issues between Trustee and EMC are questions of law and the parties agreed to submit briefs to the Court arguing their respective positions. Pursuant to Fed.R.Civ.P. 52, made applicable to this proceeding by Fed. R. of Bankr.P. 9014 and 7052 1 , the Court makes the following…
