MEMORANDUM OPINION AND ORDER

RICHARD H. KYLE, District Judge..Plaintiff Ceres Environmental Services, Inc. (“Ceres”) alleges in this action that Defendant Arch Specialty Insurance Company (“Arch”), its insurer, failed to pay all the costs it incurred defending a lawsuit brought against it in state court in Alabama. Presently before the Court is Arch’s Motion for Summary Judgment. For the reasons that follow, its Motion will be granted.
