Respondent is the sole surviving parent of Russell Perkins who W'as an unmarried minor between twenty and twenty-one years old when killed in a collision with one of appellant’s trains while he was driving an automobile south on U. S. Highway 71 at the crossing of the highway and appellant’s main track at Tipton Ford, Missouri. This is an action for damages on account of his death. The jury returned a verdict for defendant. Plaintiff’s motion for a new trial was sustained on the ground of error in certain instructions given at defendant’s request. Defendant thereupon appealed from the court’s…
