These are two actions of contract to recover a real estate broker’s commissions brought between the same plaintiff and the same defendant. The first case was entered in the District Court of East *181Norfolk, Docket No. 1410, on April 23, 1973. The Second Case was remanded from the Norfolk County Superior Court for trial in the District Court of East Norfolk, Docket No. 2773, on August 23, 1973. The cases were consolidated for trial on March 7, 1974. Both cases were heard by the same trial justice.
